1. Relevant standards
In addition to the requirements stipulated by law, product labels are also subject to relevant provisions in certain national standards and industry standards. Therefore, for specific products, in addition to complying with applicable legal requirements for labeling, producers should also consult the corresponding product standards and follow the labeling requirements set forth therein.
For example, the General Rules for Labeling Prepackaged Foods—GB 7718-2011—sets forth clear and specific requirements regarding the information that must be indicated on the labels of prepackaged foods, including: basic and general requirements; food name; ingredient list; net content and specifications; name, address, and contact information of the producer; date of manufacture; storage conditions; production license number; product standard code; and exemptions from labeling requirements. By studying and familiarizing themselves with this standard, producers of prepackaged foods can readily determine the specific information that their labels must include. The General Rules for Nutrition Labels on Prepackaged Foods—GB 28050-2011—provides detailed regulations on the description and presentation of nutritional information on nutrition labels for prepackaged foods: mandatory labeling items and optional labeling items; methods for expressing nutritional components; and categories of prepackaged foods exempt from mandatory labeling. The standard GB 1499.1-2008, "Steel for Reinforced Concrete—Part 1: Hot-Rolled Plain Round Bars," stipulates that "the packaging, marking, and certificate of quality for steel bars shall comply with the relevant provisions of GB/T 2101—General Specifications for Acceptance, Packaging, Marking, and Certificate of Quality of Section Steel." The Standard GB 5296.4-2012, "Instructions for Use of Consumer Products—Part 4: Textiles and Clothing," specifies in detail the basic principles, labeling content, and labeling requirements for instructions on textiles and clothing. The labeling content includes such items as product name, manufacturer’s name and address, product size or specification, fiber composition and content, care instructions, applicable product standards, safety category, and precautions for use and storage. Producers of textiles and clothing shall carry out labeling in accordance with the provisions of this standard.
2. Contractual Agreement
Except as otherwise provided by law and relevant standards, in special circumstances, the labeling content for products may be determined according to the contractual agreements between the parties. For example, for exported products, domestic producers shall label them in accordance with the requirements of the importing party. In certain cases involving commissioned processing, producers shall label the products according to the requirements of the commissioning party.
